Federal Judge On Obscenity Case Posted Porn Images On His Web Server techdirt.com — A lot of attention is suddenly getting turned on judge Alex Kozinski, the 9th Circuit chief judge, who (while in the middle of a trial about obscenity) was discovered to have posted pornographic images to his web server in a way in which they were accessible to the public. He didn't post them to a specific page or anything. It's just that he put them in an unprotected directory, and if you knew where to look, you could find them. Basically, it looks like he was just using the directory for personal storage, not realizing that it was publicly accessible, though, at one point he appears to claim he uploaded the images by accident. Some of the images were... extreme. Judge Kozinski described them as "funny" and "I think it's odd and interesting. It's part of life." French ISPs Agree To Censor The Web techdirt.com — Well here's a news story that actually combines two separate recent stories here. France, who we've just talked about for its repeated mistake in blaming platforms for the actions of their users, has followed down the same path that New York state just trekked concerning misguided concepts on how to stop objectionable content online. That is, France is now requiring ISPs to block a list of sites that it determines as objectionable. Apparently the list will be based on sites flagged by web users. Why Should XM Have To Get Permission From The Recording Industry To Innovate? techdirt.com — In a rather disappointing move, satellite radio company XM has now settled with EMI concerning a lawsuit over its Inno device, that allowed users to record XM streams. This follows XM's similar settlements with the other major record labels last year. No terms are being announced, which is problematic. The whole problem with this lawsuit was the fact that the record labels seemed to believe that XM was unable to innovate without getting their permission and paying them. The Inno device was simply a device to record satellite radio streams -- which is perfectly legal. Time shifting and recording radio is well-established as being legal. MPAA Asks FCC To Allow It To Block DVR Recording Of Certain Movies techdirt.com — The entertainment industry lobbyists are basically working ever possible angle to get more "control" over its content. We've already seen how they mess with the legislation process and the international treaty process, and now they're trying to use the FCC as well (not for the first time, either). The latest is that the MPAA is asking the FCC to remove certain restrictions that forbid it from blocking the recording of certain movies and from downgrading the ability to record certain movies. Basically, the MPAA is asking the FCC let it make use of "Selectable Output Control" to keep its rapidly disappearing "release windows" business model possible.
